주택의 연면적이 주택 외 부분의 연면적보다 작거나 같은 경우에는 주택 외의 부분은 주택으로 보지 아니하므로(소령 154조 3항 단서) 주택 외의 부분의 양도차익에서는 1세대 1주택의 비과세가 배제되고 장기보유특별공제도 소법 95조 제2항 [표1](최대30%)을 적용함. 이 경우 주택부분의 양도가액이 12억원 이하인 경우 주택부분만 비과세되며, 주택부분의 양도가액이 12억원을 초과하는 경우에는 주택부분 중 비과세대상에서 제외되는 양도차익과 장기보유특별공제액은 소령 160조 1항에 따라 계산함(소령 160조 1항).
